This blog post explains what Wwft, PEP, and EDD (Enhanced Due Diligence) are and how they work.&nbsp;<\/p>\n\n\n\n<div style=\"height:30px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h1 class=\"wp-block-heading\">Legislation against crime<\/h1>\n\n\n\n<p>De Wet ter voorkoming van witwassen en financieren van terrorisme (Wwft) is een Nederlandse wet, die is ingevoerd om aan de verplichtingen uit de Europese Anti Money Laundering-richtlijn te voldoen. De Europese richtlijn is bedoeld om financi\u00eble stelsels te beschermen tegen misbruik door criminelen die opbrengsten van hun misdrijven proberen wit te wassen. Daarnaast beoogt de richtlijn het financieren van terrorisme tegen te gaan. De Wwft verplicht financi\u00eble instellingen in Nederland dan ook om adequate maatregelen te nemen ter voorkoming van witwassen en financieren van terrorisme.&nbsp;<\/p>\n\n\n\n<p>Deze financi\u00eble regelgeving heeft dus invloed op werkwijzen binnen de financi\u00eble sector, bijvoorbeeld bij de CDD-beoordeling van PEP\u2019s. PEP\u2019s zijn personen die een publieke functie of politiek gevoelige posities bekleden, zoals hoge regeringsfunctionarissen of parlementsleden. Financi\u00eble instellingen moeten elke klant die aan deze definitie voldoet als hoger risico beoordelen wanneer zij zaken met hen doen, vanwege hun mogelijke toegang tot onrechtmatige middelen of invloed op de besluitvorming. Op grond van de Wwft moeten alle financi\u00eble instellingen daarom Enhanced Due Diligence (EDD) onderzoek uitvoeren op alle klanten die als PEP zijn aangemerkt, om ervoor te zorgen dat er geen onwettig geld via hun rekeningen wordt verwerkt.&nbsp;<\/p>\n\n\n\n<p>Wwft gatekeepers must also be alert to sanctions against (legal) persons in the Netherlands. Sanctions may include freezing assets or imposing a travel ban. These sanctions must be implemented if a customer's name matches a person or legal entity on a sanctions list maintained by national authorities and international organizations such as OFAC. It is essential for companies doing business in the Netherlands to have processes in place to screen clients on these sanctions lists to remain compliant with Wwft regulations.&nbsp;<\/p>\n\n\n\n<p>Inzicht in Wwft, PEP&#8217;s, EDD en andere aspecten van het Nederlands financieel recht is essentieel voor CFO&#8217;s en compliance officers die op deze markt actief zijn. Het is belangrijk voor deze personen om bekend te zijn met de regelgeving rond witwaspreventie, de beoordeling van politiek prominente personen, uitgebreide <em>due diligence<\/em>-requirements and any applicable sanction lists so that their business remains compliant with all local laws and regulations.
