Deze maatregelen zijn bedoeld om EU-burgers en het financi\u00eble stelsel te beschermen tegen financi\u00eble criminaliteit. Hier leest u alles over deze belangrijke ontwikkelingen en wat ze betekenen voor de toekomst.<\/p>\n<h2>Stricter rules<\/h2>\n<p>De Raad heeft een uitgebreid pakket nieuwe regels aangenomen dat onze systemen zal versterken in de strijd tegen witwassen en terrorismefinanciering. Een nieuw agentschap in Frankfurt zal toezicht houden op de naleving van deze regels. Dit betekent dat fraudeurs, georganiseerde misdaad en terroristen geen ruimte meer krijgen om hun illegale winsten het financi\u00eble stelsel binnen te sluizen.<\/p>\n<h2>The regulatory package<\/h2>\n<p>On July 20, 2021, the European Commission presented a package of legislative proposals to strengthen EU regulations to combat money laundering and terrorist financing. This package includes:<\/p>\n<ul>\n<li>An ordinance establishing the AMLA, authorized to impose penalties and fines.<\/li>\n<li>A regulation to make remittances, including crypto assets, more transparent and traceable.<\/li>\n<li>A regulation on anti-money laundering obligations for the private sector.<\/li>\n<li>A directive on national anti-money laundering mechanisms.<\/li>\n<\/ul>\n<p>On Nov. 25, 2021, the Commission also submitted a proposal for a central access point directive.<\/p>\n<h2>A unified approach<\/h2>\n<p>Het nieuwe regelpakket brengt alle bestaande regels voor de particuliere sector samen in \u00e9\u00e9n direct toepasbare verordening. Dit zorgt voor uniformiteit binnen de hele EU, zodat fraudeurs niet langer achterdeuren kunnen vinden in verschillende nationale systemen. Minister Vincent Van Peteghem van Belgi\u00eb benadrukt het belang van deze stap voor een effectieve bestrijding van financi\u00eble criminaliteit.<\/p>\n<p>Bovendien worden de regels uitgebreid naar nieuwe meldingsplichtige entiteiten zoals cryptohandelaren, handelaren in luxegoederen en voetbalclubs. Er worden striktere eisen gesteld aan cli\u00ebntenonderzoek en aan de uiteindelijke begunstigden van financi\u00eble transacties. Contante betalingen worden beperkt tot \u20ac 10.000, wat de transparantie verder vergroot.<\/p>\n<h2>Een beter georganiseerd antiwitwassysteem<\/h2>\n<p>De richtlijn in het pakket zorgt voor een betere organisatie van de nationale antiwitwassystemen. Dit omvat duidelijke regels voor samenwerking tussen financi\u00eble inlichtingeneenheden (FIE&#8217;s) en toezichthouders. De nieuwe AMLA krijgt zowel directe als indirecte toezichtbevoegdheden over entiteiten met een hoog risico in de financi\u00eble sector. Dit ge\u00efntegreerde toezichtmechanisme zorgt ervoor dat alle meldingsplichtige entiteiten voldoen aan hun verplichtingen op het gebied van antiwitwassen en terrorismefinanciering.<\/p>\n<p>Daarnaast zullen de EU-lidstaten informatie uit centrale bankrekeningregisters beschikbaar stellen via een centraal toegangspunt. Dit betekent dat nationale rechtshandhavingsinstanties toegang krijgen tot deze informatie, wat cruciaal is voor het bestrijden van strafbare feiten en het opsporen en in beslag nemen van misdaadopbrengsten.<\/p>\n<h2>Next steps and implementation<\/h2>\n<p>Dit pakket regels markeert de laatste stap in de goedkeuringsprocedure. De tekst zal binnenkort in het Publicatieblad van de EU worden bekendgemaakt en vervolgens in werking treden. De antiwitwasverordening treedt drie jaar na de inwerkingtreding in werking. Lidstaten hebben twee jaar de tijd om bepaalde delen van de richtlijn om te zetten en drie jaar voor de volledige implementatie.<\/p>\n<p>De nieuwe AMLA wordt gevestigd in Frankfurt en zal medio 2025 operationeel zijn.
